Acceptance of terms
By accessing or using TrialDay (trialday.app) you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.
These terms constitute a binding legal agreement between you and TrialDay ("we," "our"), the operator of trialday.app.

Description of service
TrialDay provides AI-powered job simulation software that lets users experience realistic workdays in various professional roles. Simulations include AI-generated teammates, tickets, emails, and scoring.
We offer a free tier and paid subscription plans (Pro and Business) as described on our pricing page. Feature availability varies by plan.

Accounts and eligibility
You must be at least 13 years old to use TrialDay. By creating an account you represent that you meet this requirement.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You may not share, sell, or transfer your account to another person.

Acceptable use
You agree not to use TrialDay to: (a) violate any applicable law or regulation; (b) transmit harmful, abusive, or fraudulent content; (c) attempt to reverse-engineer, scrape, or interfere with the platform; (d) create multiple accounts to circumvent free-tier limits.
Simulations are for personal professional development or company hiring assessment purposes only. Redistribution of simulation content is not permitted.
We reserve the right to suspend or terminate accounts that violate these terms.

Subscriptions and billing
Paid plans are billed monthly or annually in advance. All fees are in US dollars and are non-refundable except as described in our refund policy.
Refund policy: if you are not satisfied within the first 7 days of a paid subscription, email info@trialday.app for a full refund — no questions asked.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you will not receive a prorated refund for unused time beyond the 7-day window.
We may change pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.
Billing is processed by Stripe. By subscribing you agree to Stripe's terms of service.

Company simulation feature
Business plan subscribers may create custom simulations and share them with candidates. You are responsible for ensuring you have the right to collect and process candidate data under applicable employment and privacy law.
TrialDay is a tool to assist — not replace — your hiring process. Scores and reports are AI-generated and should not be the sole basis for any hiring decision.
You must obtain candidate consent before sending them a simulation link where required by law.

Intellectual property
TrialDay and its content (software, design, text, graphics) are owned by TrialDay and protected by copyright and other intellectual property laws.
You retain ownership of any content you create within simulations (e.g., documents you write). You grant TrialDay a limited license to store and process that content to provide the service.
Feedback and suggestions you provide may be used to improve the service without compensation or attribution.

Disclaimers and limitation of liability
TrialDay is provided "as is" without warranties of any kind, express or implied. We do not guarantee that simulations accurately reflect any specific employer's work environment or hiring criteria.
Simulation scores and feedback are generated by AI and are for informational purposes only. They are not professional career advice.
To the maximum extent permitted by law, TrialDay's total liability to you for any claim arising from these terms or your use of the service shall not exceed the amount you paid to TrialDay in the 12 months preceding the claim.

Changes to the service and terms
We may modify or discontinue the service (or any part of it) at any time. For material changes to these Terms we will provide at least 14 days' notice by email or a notice in the app.
Your continued use after the notice period constitutes acceptance of the updated Terms.

Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the courts of Delaware.
